1. Acceptance of Terms

By accessing and using CertStud ("we", "us", "our"), you accept and agree to be bound by the terms and provision of this agreement. These Terms apply to all visitors, users, and others who access or use the Service.

CertStud is owned and operated by Filantus. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

CertStud provides online certification study materials, practice exams, flashcards, and educational resources for various professional certifications including but not limited to:

• Microsoft Azure certifications (AI-102, AZ-104, AZ-900, etc.)
• Amazon Web Services (AWS) certifications
• Google Cloud Platform (GCP) certifications
• CISSP and other security certifications
• SAFe RTE and agile certifications
• TOGAF and enterprise architecture certifications
• Salesforce certifications
• Other professional and academic certifications

3. User Accounts

To access certain features of the Service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and identification
• Promptly update account information to keep it accurate
• Accept all risks of unauthorized access to your account
• Notify us immediately of any unauthorized use of your account

4. Subscription and Payment Terms

4.1 Subscription Plans

We offer the following subscription plans:

• Free Plan: Limited access to select study materials
• Single Track ($19/month): Full access to one certification of your choice
• All Access/Premium ($49/month): Unlimited access to all certifications

Each paid plan includes unlimited practice questions, full practice exams, interactive flashcards, study notes, progress tracking, and email support.

4.2 Payment Processing

Payments are processed securely through Clerk Billing powered by Stripe. We do not store your payment information on our servers. By subscribing, you authorize Clerk/Stripe to charge your payment method for the subscription fees.

4.3 Billing and Auto-Renewal

• Subscription fees are billed in advance on a monthly or annual basis
• Subscriptions automatically renew at the end of each billing period
• You will be charged at the then-current rate unless you cancel before renewal
• You can view your next billing date in your account dashboard
• Failed payments may result in immediate service suspension
• You are responsible for updating payment information to avoid service interruption

4.4 Early User Discount Program

Early users may be eligible for a lifetime discount on subscription fees. This discount:

• Is applied automatically for eligible users
• Remains in effect for the lifetime of your subscription
• Applies to all plan upgrades and renewals
• Cannot be transferred or combined with other offers
• May be revoked if terms are violated

4.5 Price Changes

• We reserve the right to change subscription pricing at any time
• Price changes will be communicated at least 30 days in advance
• Existing subscribers will be grandfathered at their current rate for one billing cycle
• Continued use after price change constitutes acceptance of new pricing
• Early user discounts remain valid at the discounted rate

4.3 Affiliate Links and Commissions

CertStud participates in various affiliate programs and may earn commissions from qualifying purchases or sign-ups made through links on our website. This includes but is not limited to:

• Amazon Associates: We earn from qualifying purchases through Amazon affiliate links when you purchase recommended study guides and books
• Upwork Affiliate Program (via Impact.com): We may earn commissions when you sign up or hire through Upwork job links displayed on our platform
• Other affiliate partnerships as disclosed on our website

These affiliate relationships do not affect the price you pay, nor do they influence our content or recommendations. We only recommend products and services we believe will provide value to our users. Revenue from affiliate programs helps support our free study materials and platform operation.

4.6 Cancellation Policy

You may cancel your subscription at any time through your account dashboard or by contacting support:

• Cancel Anytime: No cancellation fees or penalties
• Access Through Billing Period: Upon cancellation, you retain full access until the end of your current billing period
• No Partial Refunds: Cancellation does not entitle you to a refund for the current billing period
• Automatic Non-Renewal: Your subscription will not renew after cancellation
• Data Retention: Your study progress and account data are retained for 30 days after cancellation
• Reactivation: You may reactivate your subscription at any time, subject to current pricing

4.7 Refund Policy

Our refund policy is as follows:

• No Refunds: All subscription fees are non-refundable except as required by law
• Service Issues: If you experience technical issues preventing access, contact support immediately
• Billing Errors: Incorrect charges due to system errors will be refunded promptly
• Fraudulent Charges: Unauthorized charges will be refunded after verification
• Legal Requirements: Refunds will be provided as required by applicable consumer protection laws

To request a refund for a valid reason, please contact support within 7 days of the charge with your order details.

4.8 Plan Upgrades and Downgrades

• Upgrades: Take effect immediately, you are charged the prorated difference for the current billing period
• Downgrades: Take effect at the end of the current billing period
• Certification Changes: For Single and Dual Track plans, certification selections can be changed according to plan limits
• Early User Discounts: Are preserved during upgrades and downgrades

5. Acceptable Use Policy

You agree not to use the Service:

• For any unlawful purpose or to solicit others to unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To spam, phish, pharm, pretext, spider, crawl, or scrape
• For any obscene or immoral purpose
• To interfere with or circumvent the security features of the Service
• To share account credentials or access with unauthorized parties

6. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of CertStud and its licensors. The Service is protected by copyright, trademark, and other laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7. Content and Educational Use

Our study materials are designed for educational purposes to help users prepare for certification exams. All content is created for learning and reference purposes only.

• Content may not be redistributed, sold, or shared outside the platform
• Screenshots or copying of materials is prohibited
• Materials are provided for personal study use only
• We do not guarantee specific exam results or certification success

8. Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our Service. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy.

9. Disclaimers and Limitations

THE INFORMATION ON THIS PLATFORM IS PROVIDED ON AN "AS IS" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, THIS COMPANY EXCLUDES ALL REPRESENTATIONS, WARRANTIES, CONDITIONS AND TERMS.

• We do not warrant that the service will be uninterrupted or error-free
• Study materials are for educational purposes and exam success is not guaranteed
• Certification requirements and exam content may change without notice
• We are not affiliated with certification providers unless explicitly stated

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service.

11. Governing Law

These Terms shall be interpreted and governed by the laws of the United States, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
